Medical Marijuana Laws for Patients
The legal risks to physicians regarding issuing recommendations for medical marijuana seem to be quite minimal. In 2015, Medscape reported that after contacting multiple national and regional medical malpractice insurance carriers, as well as medical societies in several states, it could not find any instances of physicians facing malpractice lawsuits due to medical marijuana recommendations.
There have been reports of physicians losing medical licenses due to writing recommendations in a manner that was considered improper or unsafe. Two doctors in Colorado, for example, were suspended by their state board and ultimately surrendered their medical licenses. One of them reportedly provided a pregnant woman with a recommendation despite never having examined her. Another reportedly issued recommendations to patients after meeting them in places such as hotels and tattoo parlors, according to Medscape. The doctor in the latter example never scheduled any follow-up visits with those patients.
Medscape also reported that the U.S. Department of Justice recommended in 2013 that legal action not be pursued against doctors who recommend medical marijuana. The federal government continues to classify marijuana as a Schedule I drug, but its main priorities include preventing illegal distribution to minors and preventing revenue from marijuana sales from including criminal enterprises.
If you are a first-time medical marijuana patient, you should realize that medical cannabis laws don’t allow doctors to write prescriptions for marijuana. They can only write recommendation letters that show you qualify to use the drug. In order to obtain your medicine, you will need to go to a legally recognized dispensary.
If you live in a state where it is legal to smoke medicinal weed, you still need to be aware of your local marijuana laws. You may have an encounter with a law enforcement officer, and you need to know your rights. When you medicate, make sure you use common sense. Marijuana obviously has a distinctive smell, so try to avoid being in public after you smoke. If you are driving, get pulled over and the officer smells weed, it could lead to an embarrassing situation. Also remember that even if your weed is legal, it’s still illegal to drive under the influence.
If you grow your medicinal marijuana, the fewer plants you have the less attraction you’ll draw from people who might mean you harm, such as thieves or neighbors who might want to make trouble. Have a good idea of the amount of cannabis you’ll need, so you can safely limit what you cultivate.
